Terms of Service

Article 1 (Purpose)

These Terms of Service aim to define the rights, obligations, and responsibilities between Fitculator (hereinafter referred to as "Company") and users regarding the use of mobile applications and related services (hereinafter referred to as "Services") provided by the Company.

Article 2 (Definitions)

  • "Service" means the mobile application related to exercise measurement and health management provided by the Company.
  • "User" means members and non-members who receive services provided by the Company in accordance with these Terms.
  • "Member" means a person who has registered as a member by providing personal information to the Company, continuously receives information from the Company, and can continuously use the services provided by the Company.
  • "Non-member" means a person who uses the services provided by the Company without joining as a member.

Article 3 (Effectiveness and Amendment of Terms)

  • These Terms take effect for all users who wish to use the Service.
  • The Company may amend these Terms when deemed necessary, and will promptly notify users of any changes.
  • Amended Terms take effect upon notification, and users who do not agree to the amended Terms may discontinue use of the Service and withdraw their membership.

Article 4 (Provision of Services)

  • The Company provides the following services:
    • Exercise measurement and recording service
    • Exercise analysis service based on WHO recommendations
    • Personalized exercise recommendation service
    • Health data management service
    • Other services determined by the Company
  • Services are provided 24 hours a day, 365 days a year in principle. However, services will not be temporarily suspended unless there are special business or technical difficulties.
  • The Company may conduct regular maintenance to improve services, and the regular maintenance time will be announced on the service screen.

Article 5 (Membership Registration)

  • Users apply for membership by filling out member information according to the registration form set by the Company and expressing their agreement to these Terms.
  • The Company registers as members those users who have applied for membership as described in Paragraph 1, except for the following cases:
    • When the applicant has previously lost membership qualifications under these Terms
    • When there are false statements, omissions, or errors in the registration information
    • When the Company determines that registering as a member would cause significant technical difficulties
  • The membership contract is established when the Company's approval reaches the member.

Article 6 (Changes to Member Information)

  • Members can view and modify their personal information at any time through the personal information management screen.
  • When information provided during membership registration changes, members must make corrections online or notify the Company of such changes via email or other methods.
  • Members are responsible for any disadvantages arising from failure to notify the Company of changes mentioned in Paragraph 2.

Article 7 (Privacy Protection)

  • The Company collects minimal personal information within the scope necessary for service provision when collecting users' personal information.
  • The Company does not collect information necessary for purchase contract fulfillment in advance during membership registration. However, this does not apply when collecting minimal specific personal information for identity verification required by relevant laws before purchase contracts.
  • When collecting and using users' personal information, the Company notifies the purpose to the relevant user and obtains consent.
  • The Company cannot use collected personal information for purposes other than intended, and when new purposes arise or when providing information to third parties, the Company notifies the purpose to the relevant user and obtains consent at the use/provision stage.

Article 8 (User Obligations)

  • Users must not engage in the following acts:
    • Registering false information when applying or making changes
    • Stealing others' information
    • Altering information posted by the Company
    • Transmitting or posting information other than that designated by the Company (such as computer programs)
    • Infringing on intellectual property rights such as copyrights of the Company or third parties
    • Damaging the reputation or interfering with the business of the Company or third parties
    • Publishing or posting obscene or violent messages, images, voices, or other information contrary to public order and morals on the service
  • Users must comply with relevant laws, provisions of these Terms, usage guidelines, notices posted on the service, matters notified by the Company, and must not engage in acts that interfere with the Company's business.

Article 9 (Company Obligations)

  • The Company must not engage in acts prohibited by laws and these Terms or contrary to public order and morals, and must do its best to provide services continuously and stably in accordance with these Terms.
  • The Company must establish a security system to protect users' personal information (including credit information) so that users can safely use internet services.
  • When opinions or complaints raised by users regarding service use are objectively recognized as legitimate, the Company must immediately process them through appropriate procedures.

Article 10 (Service Usage Restrictions)

  • The Company may gradually restrict service usage through warnings, temporary suspensions, or permanent suspensions when users violate obligations under these Terms or interfere with normal service operations.
  • Notwithstanding the preceding paragraph, the Company may immediately impose permanent usage suspensions for violations of relevant laws such as identity theft and payment fraud violating the Resident Registration Act, provision of illegal programs and operational interference violating copyright laws and computer program protection laws, illegal communications and hacking violating information and communications network laws, distribution of malicious programs, and acts exceeding access authority.
  • When the Company restricts or suspends service usage, it will notify users of the reasons and restriction period.

Article 11 (Limitation of Liability)

  • The Company is exempt from liability for service provision when services cannot be provided due to natural disasters or equivalent force majeure.
  • The Company is not liable for service usage obstacles caused by users' negligence.
  • The Company is not liable for users' loss of expected profits from using the service, nor for damages caused by materials obtained through the service.
  • The Company has no obligation to intervene in disputes between users or between users and third parties mediated through the service, nor is it liable for compensating damages arising therefrom.

Article 12 (Dispute Resolution)

  • In case of disputes regarding these Terms, the competent court shall be the court with jurisdiction under the Civil Procedure Act.
  • Lawsuits regarding disputes between the Company and users shall apply Korean law, and the court with jurisdiction over the Company's headquarters location shall have agreed jurisdiction.
